On Tuesday, August 8, 2017, Kenyans went to the polls to elect politicians who will lead them for the next five years.
Barely hours later, the National Super Alliance (NASA), led by Raila Odinga, came out to dispute the results that were being transmitted by IEBC.
The Opposition head complained that the results relayed by the Independent Electoral and Boundaries Commission (IEBC) on its website and used by the media were not legit.
According to him, the results in which showed incumbent President Uhuru Kenyatta leading, were unprocedurally submitted due to lack of the all-important Forms 34As and 3Bs.
We will try to remove the mystery surrounding the issue as many Kenyans don’t understand what the two forms are and their importance in the electoral process.
The writer will try to break down their importance and what function they play as enshrined in law.
Firstly, Form 34A is the first form used to tabulate results of the presidential election. It is filled by the Presiding Officer (PO) after completion of vote counting at every polling station. A total of 40,883 polling stations were used in the last polls.
Form 34A forms the basis of the election results as it has details of the votes garnered by each candidate while also indicating the total number of registered voters in that station, the rejected votes, votes being disputed and the valid votes.
All agents representing political parties or candidates are required to sign and ratify that the contents of that form are correct before the results are sent.
The Constituency Returning Officer (CRO) receives all Forms 34As from all the polling stations in his jurisdiction and transfers the information to Form 34B. The information in Form 34B is used for the tallying of the presidential election results.
Form 34B carries the following information; the polling station code, the name of the station, the number of registered voters, what each candidate garnered and the number of valid votes cast. The information therein is final and cannot be changed. This is what was contested by IEBC in court although Nasa had its way.
The CRO then relays the form to the chairman of the IEBC, who is the Returning Officer for the presidential election for the results to be announced.
