Nairobi Landlord has issued an eviction notice and ready to face the court with a Nairobi Member of County Assembly over rent arrears.
Through an affidavit filed before court through lawyer Samuel Ayora, Felix Nyakundi, the applicant,claims that nominated MCA Rosemary Wairimu Macharia and her husband Peter Muchoki have refused to vacate his premises.
He also accuses the respondents of failing to give out their full details for security reasons in addition to failing to sign the tenancy agreement.
In the application, Ayora said his client, Mr Nyakundi, fears that in the event the tenants turn out to be a security threat to the nation, he will be held accountable because he does not have their personal records.
He has accused the respondents of failing to pay rent for seven months out of the 15 months they have been living in his house.
“My client stands to lose immensely if the orders sought are not granted. He might be accused of aiding and abetting crime if the tenants turn out to be terrorists,” said the lawyer in the affidavit.
Nyakundi had earlier urged the tenants to vacate the premises as per notice issued on December 23, 2015, which was dully signed and filed at the rent tribunal. The two were also served with a valid termination notice to vacate the premises on March 1, 2016, but have refused to move out.
According to the affidavit, the two have not opposed the notice to vacate which was served to them.
