Today, Saturday, August 26 at 7pm, the Supreme Court will hold its first pre-trial conference in the presence of the lawyers for the National Super Alliance which is the petitioner, as well as those of co-respondents, President Uhuru Kenyatta, the Independent Electoral and Boundaries Commission and its Chair Wafula Chebukati.
Nasa claims in the petition that Chebukati and his team declared Uhuru Kenyatta President with unverified results because they had not received all 290 Form 34Bs which reflects the constituencies tally.
The coalition has said in its submission that after Wafula Chebukati made the all-important declaration on the night of Friday, August 11, Returning Officers and Presiding Officers were summoned to adjust results on the forms.
“Having declared results unsubstantiated and unverified by the requisite forms, in order to cover its nakedness, the IEBC resorted to summon its officers to fill in and sign away the various forms so that the forms would tally with the declared results,” part of the petition by Raila Odinga and Kalonzo Musyoka.
To back the alleged manipulation of the vital forms, the Opposition lawyers have presented Meru Primary School as one of the poll stations where the forms were manipulated.
“In Meru Primary, all agents signed the forms using one handwriting and no results are given. In Kathugu Primary, the purported Form 34 A shows the party agent to be a NASA agent while the third respondent is shown as the candidate.
“In Gem constituency, the stamp used is inconsistent with the Returning Officer’s official stamp. The same was seen in Konoin and North Imenti,” the coalition says it its submissions.
The poll body however vehemently denies the allegations saying in its response that its head Wafula Chubukati declared Uhuru the winner while in full possession of all verified results and documents.
IEBC insists it carried out an election that was beyond reproach and has submitted a 50,000-page evidence to back its innocence.
