A boda boda rider in Migori County has been sentenced to 15 years in prison after being found guilty of raping and assaulting a 50-year-old woman in Rongo.
The incident took place on the night of March 28, 2024, at approximately 10:00 PM in Matufali village, Rongo Sub-County.
The convict, identified as Fredrick Ojwang, received the sentence from Principal Magistrate Susan Mutava, who handed down a 10-year jail term for the rape charge and an additional five years for assault causing actual bodily harm.
In her judgment, Magistrate Mutava stated, “After reviewing the evidence alongside the relevant legal provisions and established precedents, the prosecution has successfully proven the case beyond reasonable doubt. Therefore, the accused is convicted of rape and assault causing actual bodily harm.”
The prosecution presented four witnesses during the trial. One key witness testified that on the night of the incident, around 11:00 PM, he was riding his motorcycle when he came across a stationary boda boda near a bush in Matofali area.

He noticed two individuals on the ground and, upon switching off his motorbike, heard the victim screaming for help.
The court also emphasized the credibility of the victim’s testimony, describing her account as clear, coherent, and consistent.
Additionally, medical reports submitted to the court confirmed the occurrence of penetration, further strengthening the prosecution’s case.
